City man pleads innocent to 19 felony charges
A Warren man has pleaded innocent to the 19 felony charges involving an alleged child rape lodged against him in January.
David S. Gonzalez, 31, was charged in late January with two counts of rape of a child, a class 1 felony, two counts of statutory sexual assault: 8-11 years older, a class 2 felony; two counts of sexual assault, a class 2 felony; two counts of aggravated indecent assault of a child, a class 1 felony; two counts of aggravated indecent assault without consent, a class 2 felony; two counts of aggravated indecent assault – person less than 13 years old, a class 2 felony; two counts of indecent assault involving a person less than 13 years of age, a class 3 felony; two counts of unlawful contact with a minor – sexual offenses, a class 1 felony; three counts of corruption of minors – defendant age 18 or above, a class 3 felony; indecent exposure, a class 1 misdemeanor, and marijuana possession – small amount personal use after an investigation by the State Police at Warren.
He pleaded innocent to those charges Thursday in front of Judge Maureen Skerda. The marijuana possession charge has been withdrawn while the rest will proceed to court. Gonzalez was arraigned by Magisterial District Judge Raymond Zydonik on Saturday and bail set at $100,000. Gonzalez remains in the Warren County Prison.
According to the Affidavit of Probable Cause filed by the State Police, the Warren Child Advocacy Center scheduled an interview on Friday for a 9-year-old girl who disclosed several incidents that allegedly occurred between Jan. 1, 2024, and Jan. 23, 2025. The girl said the incidents happened at home. An arrest warrant was issued based on the girl’s testimony.
Arraignment was waived in a second set of charges alleging rape of a child. Dillon Gray, 33, waived arraignment after being charged in January rape of a child, statutory sexual assault: 11 years older and involuntary deviate sexual intercourse with a child, all class 1 felon charges. He is also charged with incest of a minor – complainant under 13 years of age, a class 2 felony, corrupton of minors – defendant age 18 or above, a class 3 felony, and indecent assault of a person less than 13 years of age, a class 3 felony.
According to the criminal court docket, the incident allegedly took place Dec. 30, 2022, in Glade Township. On Sept. 30, 2024, a forensic interview was conducted at the Warren County Children’s Advocacy Center after State Police at Warren received a report of suspected child abuse from Warren County Children and Youth Services. The girl, according to an affidavit of probable cause, reported that Gray had “hurt her.” The affidavit detailed behavior that allegedly took place between Gray and the 2-year-old in “his tree house” where there were toys for her to play with. The girl said the activity took place more than once.
Also appearing in court on Thursday were:
– Richard E. Rodgers, 60, of Warren pleaded innocent Thursday to charges of DUI: highest rate of alcohol (BAC. .16% or higher) – first offense; DUI: general impairment/incapable of driving safely – first offense; and following too closely Nov. 10 by Warren City Police officers.
– Arraignment in a case involving an assault in the Warren County Prison was continued by the court. Cody S. Phinney, 33, was charged Dec. 19 by Warren city police with aggravated assault – attempts to cause serious bodily injury or causes injury with extreme indifference, a class 1 felony, simple assault and harassment – subjecting another to physical contact for incidents that allegedly happened Dec. 10. Phinney’s address is listed as the Warren County Prison, indicating he had not yet been transferred to a state correctional institute. The Affidavit of Probable Cause indicates the incident began at 5 p.m. Dec. 9, when video surveillance in the jail shows Phinney arguing with another inmate in the jail before Phinney walked away toward a bathroom area. At 5:08 p.m., Phinney allegedly left the bathroom and approached the other inmate again. That’s when the incident became violent, according to the affidavit. Photographs taken by Warren County Prison staff on Dec. 9 show the other inmate with a swollen bruise next to his right eye, allegedly the result of Phinney’s first punch, as well as a swollen left elbow sustained when he fell to the ground. According to the police report, the second man needed surgery to repair his injured left elbow while the victim also fractured his left radial head and radial neck.
– Ashley N. Good, 32, of Warren pleaded guilty at arraignment to charges of simple assault and resisting arrest while charges of second-degree felony aggravated assault, harassment and criminal mischief were not prosecuted. Good was charged Feb. 10 by Warren city police officers for an incident that allegedly took place Feb. 7 in Warren.
Brandon C. Dean, 39, of Grand Valley pleaded guilty at arraignment to a charge of receiving stolen property, though the charge was reduced from a third-degree felony to a second-degree misdemeanor. Dean will pay restitution of $3,316 to U-Haul.
Arraignment was waived in the following cases:
– Bryan Keith Vanord Bair, 18, of Russell was charged with two counts of unlawful contact with a minor – sexual offenses, a class 3 felony; corruption of minors – defendant age 18 or above, a class 3 felony; indecent assault without consent of other, indecent assault forcible compulsion and indecent assault person less than 16 years of age after an investigation by the State Police at Warren.
– Damion E. Dalton, 20, of Jamestown was charged Sunday by the State Police at Corry with burglary, a class 2 felony; retail theft, a class 3 felony, criminal trespass – breaking into a structure, a class 2 felony; and criminal mischief – damaging property, a class 3 felony. He also faces a second-degree felony charge of theft by unlawful taking. Dalton is accused of breaking into the Tall Tales Sporting Goods Store on Market Street, Pine Grove, in December. In New York state he faces one count of third-degree criminal possession of a weapon (possession of an assault weapon), two counts of third-degree criminal possession of a weapon (high capacity magazines), two counts of third-degree criminal possession of a weapon (defaced), and one count of fourth-degree criminal possession of stolen property.
– Christopher L. Gage, 32, of Warren who was charged with failure to register with the Pennsylvania State Police Jan. 15 for an incident Nov. 1 in Brokenstraw Township.
– Christopher Johnston of Greenville, Pa., who was charged with two counts of perjury, a class 3 felony, Dec. 27 for an offense Sept. 30.
– Rayden Perrett, 19, of Sugar Grove who was charged with theft by unlawful taking – movable property, a class 2 felony; theft from a motor vehicle, a class 3 felony; loitering and prowling at night time, a misdemeanor; firearms not to be carried without a license, a class 3 felony; hindering apprehension/prosecution – providing aid, a class 3 felony; receiving stolen property, a class 3 felony; criminal mischief – tampering; receiving stolen property, a class 2 felony; conspiracy – theft by unlawful taking – movable property, a class 3 felony; and conspiracy – theft by unlawful taking – movable property, a class 2 felony. Perrett and another teen were allegedly responsible for thefts from several vehicles in the Sugar Grove area in the fall.
– Kaylee N. Smith, 36, of Sheffield who was charged with strangulation – applying pressure to throat or neck, a class 2 felony, simple assault and harassment – subjecting another to physical contact Jan. 24 by the State Police at Warren for an incident in Sheffield Township.
