City man pleads guilty to criminal trespass
A city man who was charged in January with entering a Fifth Avenue home without permission has pleaded guilty to a charge of criminal trespass.
Edward E. Edwards of Warren pleaded guilty on Monday in front of Judge Gregory Hammond in the Court of Common Pleas. Edwards and Patricia J. Salapek, 42, were charged in early January after Warren police responded to a Fifth Avenue home after it was reported the two entered the home despite not being allowed inside. Officers arrived and, according to the Affidavit of Probable Cause, saw a path in the snow to the rear door of the home. According to the police report, officers knocked on the door and Salapek allegedly answered the door while Edwards allegedly was found in the bedroom, in bed, eating food. Officers told Edwards and Salapek to collect their belongings from the home.
Salapek and Edwards had allegedly been told by Warren police officers in September that the property owner didn’t want them inside the residence anymore.
“Edwards was read his Miranda warnings as he verbally acknowledged them,” the affidavit of probable cause states. “Edwards stated he knew he was not allowed inside … Edwards openly knew he was not to return to the residence.”
Salapek and Edwards had previously been charged with defiant trespassing Nov. 23 by city police officers. Edwards had also been charged Dec. 12 with defiant trespass by Warren city police officers for an incident that occurred Nov. 26 in Warren.
Salapek pleaded guilty to third-degree felony criminal trespass and was sentenced March 14 to a minimum of 65 days in the county jail and a maximum of one year and 11 months.
Three other guilty pleas were entered in Hammond’s court on Monday.
Scottlynn R. Hackley, 19, Sugar Grove, pleaded guilty on two separate dockets. Hackley was charged on the first docket with possession of a controlled substance, two counts of possession of drug paraphernalia and a traffic offense from an incident that occurred on Aug. 23 in the city of Warren. She pleaded guilty to possession of a controlled substance while the other three charges were not prosecuted. On a second docket, Hackley had been charged Oct. 3 with possession with intent to deliver, possession of a controlled substance and two counts of possession of drug paraphernalia in Conewango Township. Hackley pleaded guilty to possession of a controlled substance while the other charges were not prosecuted.
Richard E. Rodgers of Warren pleaded guilty to DUI: highest rate of alcohol (BAC .16% or higher) – second offense and a traffic infraction. A charge of DUI: general impairment/incapable of driving safely – second offense was not prosecuted.
