Warren man sentenced to 2-7 years in prison for DUI

A Warren man will spend between 2 and 7 years in prison after a third conviction for DUI.

John E. Porr of Warren was sentenced Friday by Judge Gregory Hammond in the Court of Common Pleas to prison after pleading guilty to a charge of DUI: highest rate of alcohol – third offense, a third-degree felony, as well as two traffic infractions. In addition to his prison sentence, Hammond said Porr will not be eligible for a Recidivism Risk Reduction Incentive but is eligible for a state drug treatment program. He will pay a $2,500 fine, be evaluated for drug and alcohol treatment as well as a mental health evaluation, have to attend an Alcohol Highway Safety School and have his driver’s license suspended for 18 months.

The following were also sentenced in Hammond’s court Friday:

Anthony M. Spitale of Warren pleaded guilty to misdemeanor theft on two separate dockets as well as pleading guilty to a charge of false ID to law enforcement. Charges of receiving stolen property, possession of a controlled substance and possession of drug paraphernalia were not prosecuted.

Spitale was sentenced to between 4 and 8 months in the Warren County jail, to run consecutively, for the guilty pleas to retail theft charges. On the first count, he will receive credit for 147 days served in the county jail, has to comply with drug and alcohol treatment, pay $1,399.20 in restitution to Walmart, is ordered to have no contact with Walmart and perform 20 hours community service. To satisfy the second guilty plea, Spitale was also sentenced to 20 hours community service. The plea to false ID to law enforcement resulted in a sentence of 2 to 4 months in the Warren County Jail to run consecutively to the first two sentences as well as 10 additional hours of community service. If no inpatient treatment is available the court has ordered Spitale to be released directly to an inpatient facility.

Robert Shorts, who had previously pleaded guilty to DUI: general impairment/incapable of driving safely – first offense and a traffic infraction, was sentenced to six months probation, a $300 fine, drug and alcohol evaluation, Victm’s Impact Panel, 15 hours of community service and a 12-month driver’s license suspension as well as a fine for the traffic infraction.
